Horses

show jumpers, dressage horses, yearlings, broodmares, ponies, recreational horses, All Stars and all other accessories and items.

All parties expressly confirm upon their participation that they have read and accepted the general information the general terms and conditions and the information and terms and conditions for sellers. They will be asked to read and accept the terms and conditions each time they create an account, place a bid and sign up an item.

1. General

1.1. Horses Auction (HA) organizes in its function as an intermediary between sellers and buyers the Horses Auction. The organization, preparation and execution of the auction are exclusively determined by Horses Auction. This means, among other things, that HA determines the course of business prior to, during and after the auction and has the authority not to auction one or more lots or to refuse to acknowledge a bid and declare it invalid and to suspend, resume the auction, to extend or cancel and/or to take other measures it deems necessary.

1.2. These auction terms and conditions are applicable to all sales agreements concluded during the auction related to the horses/ponies/lots offered via Horses Auction, as well as any agreements resulting from that.

1.3. This agreement – and the agreements which derive thereof – are governed by Belgian law. Only the Dutch text will be binding.

1.4. These terms and conditions are announced prior to the start of the auction by including them in the auction catalogue or placing them on the website of Horses Auction. All participants of the auction will, by participating in the auction, agree upon these terms and conditions being applicable during the auction and any agreement resulting from the auction.

2. Sale/Auction

2.1. During the Auction, the horses shown by Horses Auction will be presented in-hand or under the saddle (100% online auction via photo/video). Horses Auction is not the owner of any of the lots and has no direct or indirect interest in the selected lots. Horses Auction will only offer a platform for potential buyers to buy horses/ponies/lots directly from the owners of the concerned lots.

2.2. The lots will be sold during the auction by bidding in the Euro currency, unless otherwise stated. The auctioneer may determine another bid increment before starting the bidding process on a specific lot. Potential bidders/buyers will be held to their bids until a higher bid has been received. If the auctioneer awards a bid to a buyer, the relevant buyer is obliged to pay the amount due as defined in Article 3. In case of doubt concerning the validity of a bid, the previous bid can be accepted again, after which bidding can resume. In the event of any disputes arising with or during the bidding process, the decision of the auction committee shall be binding.

2.3. The buyer will, directly after the hammer falls, fill out and sign the purchase agreement for the sale of the specific horse. Telephone bids and online bids are directly binding. By signing the purchase agreement or by placing a bid online, a payment obligation and both a binding purchase agreement between buyer and seller and a mediation agreement between Horses Auction and buyer and Horses Auction and seller will be realized.

3. Settlement of auction amounts and expenses

3.1. The amount due by the buyer shall be calculated as follows:

Auction hammer price highest bid for the lot + VAT [The VAT% is indicated per lot in the catalogue]
+ Plus commission fee of 10% on the hammer price + VAT [21% VAT to Horses Auction vzw Belgium]
= Amount to be paid [The final VAT charged depends on the VAT system of the buyer, seller/lot and country of export (See also point 8.)]

The amount payable by the buyer shall become payable immediately. Payment is to be made by bank transfer. Settlement of any counter-claims is excluded.

3.2. Immediately after completion of the auction, the buyer is obliged to fulfill all his/her obligations to the auction office. Payments must be made within the stipulated period of 5 days for the total of all bids and all other amounts due. Collections have to be done within 15 days after the end of the Auction in accordance with point 5.3. If a buyer should fail to comply with this obligation, Horses Auction shall be entitled not to recognize the offer and to declare the bidding invalidate, after which the lot can be allocated to the second highest bidder and/or alternatively the lot can be made available for auction again, with the appropriate mentioning of the frivolous bidder. The buyer shall in these events be considered to be in legal default and shall be liable to compensate Horses Auction for any damage incurred, without prejudice to any other rights that Horses Auction may have. These damages consist out of the commission fee (10% + VAT) on the highest bid + the difference between the amount of the original bid and the ultimately realized amount + the amount of an all-in registration fee (+ VAT) + the costs mentioned under point 5.3. The amount of damages is directly claimable.

3.3. The amount due by the seller and the seller conditions shall be agreed upon in a separate agreement.

3.4. Horses Auction is entitled to gather information on the financial situation of a specific bidder/buyer and participant to the auction and may decide to make the conclusion of an agreement with the relevant bidder/buyer conditional, based on the information obtained and to ask for collateral such as a bank guarantee, a letter of credit or any other collateral.
Deposits: In order to offer unlimited, a one-time refundable deposit has to be paid. Horses Auction pays back a deposit upon simple request via email if there are no open bids, invoices, debts or transports/Traces. Processed in max. 15-30 days (delay and fee depend on payment method). Of course bidders can always choose to leave a deposit on the deposit account, so they don’t have to pay again each time if they want to participate in a new auction one week later or shortly afterwards, because some payment providers might charge a small fee (https://www.mollie.com/pricing#psp-block). Most bidders do it that way. It can be done how they prefer themselves.
Deposits are processed through a separate system, Horses Auction prefers not to offset them against payment requests for purchased lots. Refunds go to the same account as the incoming payment.

3.5. Buyers have the option to conclude an insurance for the lot that they purchased with a third party. This insurance is not concluded by Horses Auction.

4. Auction horses; liability

4.1. The horses/ponies/lots offered in the auction are identified by origin, sex, color and year of birth, as stated on the website www.horsesauction.com

4.2. Of the adult sport horses that will be sold through the auction, a radiographic test conducted at least 12 months prior to the auction will be asked. A standard clinical (sport horses) examination will be asked in a period of 45 days prior to the auction.

The usual requested inspections are as follows:

 Sport horses and ponies ≥ 137cm: X-ray set photos (max. 12 months old) + X-ray report (max. 12 months old) + clinical examination report (max. 45 days old).
Ponies ≥ 109cm: Clinical examination report (max. 45 days old).
Pregnant mares: Certificate of pregnancy by veterinarian + stud certificate at the latest at the time of delivery.
Broodmares: Declaration of fertility by veterinarian (max. 100 days old).
Foals: Clinical examination report (max. 45 days old).

4.3. The available veterinary findings can, if available (in time), be provided upon the request of potential buyers or viewed in the online catalogue prior to the auction and a more detailed explanation can be provided by the auction veterinarians, their deputies or (a) substitute(s) appointed by the Horses Auction organization.

4.4. Horses Auction has thus tried to offer healthy sport horses at the auction, that are suitable for sport in terms of health. Despite the precautions, HA cannot ensure all horses to be auctioned are clinically and radiographically healthy at the time of delivery.
4.4.a. The name sport horses, mainly in connection with suitability for sport, does not apply to the categories All Stars, breeding mares, pregnant mares, recreation and accessories. The All Stars section includes the sale without guarantee on certain parts of horses without inspection or with remarks on x-rays or clinical inspection or with stable vices.

4.5. The fact that inspections and reports are being asked does not mean that they are always available (on time) or cannot contain any comments. Horses Auction cannot be held liable by buyers for claims based on non-conformity of the horse to be auctioned (or any other claim based on this factual background), when it comes to the health of the horse, the performances of the horse and/or the purpose of use of the horses. If examinations or information are not available for publication, no guarantees can be derived from them.  Please view the reports and any possible comments before the auction starts.

4.6. Horses Auction has tried to compile the available information about the lots as accurately as possible. The information is aimed at giving the best possible impression of the horses, but without pretending to be complete. The organization is not responsible for the accuracy of the information on the website and in the auction catalog, on the auction site or during the auction. Information from the auctioneer goes above information on the website and/or in the auction catalog.  By signing the sales contract, or clicking the bid confirmation, the buyer confirms that he is aware of the information of the lot and the availability or possible lack of information/inspections/reports at the time of the auction. The buyer thus buys a horse in the condition in which it is at the moment of the signing of the sales contract (for online auctions: at the moment of clicking on the confirmation of the bid).

4.7. Horses Auction cannot be held liable for damages to persons or goods, which arise before, during or after the Auction, except for damages that result from intent or conscious recklessness of Horses Auction and the persons in charge of the VZW.

5. Release and transfer of risk and ownership

5.1. Immediately after a bid on a lot has been accepted, any risks related to the purchased lot shall be transferred to the buyer and any responsibility and liability, as well as all risk factors are transferred to the respective buyer. The buyer shall indemnify European Sport Horse Auction and seller from any claims brought by third parties.

5.2. Ownership of the purchased lot passes to the buyer at the time of release as defined in Article 5.3. of these terms and conditions, but not before the buyer has settled all full purchase amounts and debts and any other amounts due to European Sport Horse Auction resulting from non-compliance.

5.3. The buyer is obliged to take possession of the purchased horse/pony/lot at the place and time as specified by European Sport Horse Auction/seller, and in the absence thereof within 15 days after the end of the Auction (foals after weaning). The costs for transport and possible associated costs such as health certificates, Traces, blood tests, quarantine, (import) duties or taxes are at the expense of the buyer. If requested by European Sport Horse Auction/seller, it will be done upon presentation of a valid identity document. Delivery of the purchased lot takes place by means of its collection. Collection consists of pick up/reception of the purchased lot by the buyer. Collection may only take place after settlement of all purchase prices in full and all other amounts due by the buyer. If the buyer should refuse release or if he/she should fail to provide information or instructions required for the release, European Sport Horse Auction/seller shall remove the purchased lot and keep it in stables at the expense and risk of the buyer and then reference is made to point 3.2. In these cases, the buyer is obliged to compensate all additional costs, including in any case the stabling costs, to European Sport Horse Auction and/or the seller.

6. Shortcomings (including stable vices)

6.1. If a buyer is of the opinion that the purchased horse/item does not correspond to the agreement after actual delivery, the buyer can no longer invoke this against HORSES AUCTION if the buyer has not informed the seller and HORSES AUCTION of this within 30 days (≤29 days) after the delivery date by registered letter or e-mail with acknowledgement of receipt. If the collection by the buyer (or their carrier) is late, being: - later than 15 days after the auction date, - or later than 15 days after the agreed possible weaning date of foals, - or later than another agreed deviating collection date, then the period of 30 days after the delivery date will be shortened proportionally to a minimum of 15 days after the delivery date, provided that the seller himself has met the conditions within 15 days after the auction date to be able to have an (inter)national transport take place by providing amongst others the following by the seller: - the complete passport, - the registration in the horse database of the country of departure, - a valid registration in Traces, - and adequate assistance for making Traces for the buyer or their carrier.  All parties expressly confirm upon their participation that HORSES AUCTION reserves the right to protect its position and trusted reputation by invoking the resolutive conditions or payment suspensions mentioned in the general terms and conditions and in the seller conditions in the event of shortcomings, complaints, incomplete or non- compliant deliveries.  Claims after the above-mentioned period have to be made directly between the buyer and the seller according to the applicable legal possibilities.

6.2. The seller warrants, unless notified of such prior to the sale, that the horse purchased by the buyer does not suffer from any stable vices such as sucking air, systematic weaving or cribbing for a period of 2 x 24 hours after actual delivery to the buyer.

6.3. If a veterinarian, registered as an inspection veterinarian for horses or a horse veterinarian should state in writing that one of the stable vices listed in Article 6.2. was established in his/ her expert opinion prior to the date of actual delivery, the buyer shall be entitled to terminate the purchase agreement with all resulting consequences. The buyer will, in that case, return the horse as quickly as possible to seller. Until the actual delivery of the horse, the buyer will behave as a good guardian over the horse. Seller will accept the horse and shall within 7 days after the delivery of the horse, pay back the auction price, excluding the commission charge to buyer. Seller is not liable for compensation of any further damages of the seller. European Sport Horse Auction is not liable for any damages refraining from the termination of the purchase agreement. The termination of the purchase agreement does not affect the mediation agreement between European Sport Horse Auction and buyer.

6.4. The All Stars section includes the sale without guarantee of horses without inspection or with remarks on x-rays or clinical inspection or with stable vices.

7. Disputes

7.1. All disputes have to be declared in writing within 5 working days to the auction committee of the Horses Auction.

7.2. If the seller or Horses Auction intends to file proceedings and if the buyer is considered to be a consumer, he/she shall be given the opportunity to announce its decision pertaining to Paragraph 7.1. in writing within a period of one month. In the event of an urgent matter (summary procedure), the seller (casu quo Horses Auction) may decide to shorten that period to five business days.
7.3. In the event of a dispute between the parties, they will endeavor to resolve this dispute amicably. If one of the parties is of the opinion that no solution has been reached, then the court designated by HORSES AUCTION has exclusive jurisdiction. Belgian law applies to the agreements between HORSES AUCTION and other parties.

8. Other

8.1. After the purchase, HORSES AUCTION sends a payment request to the buyer with all amounts and bank details. After receiving all full payments on HORSES AUCTION’s account, HORSES AUCTION will exchange the contact details of the buyer and seller and vice versa to arrange the transfer of the horses, passports and invoices or private sales agreements.

8.2. Bank transfers may take some time. Have the transport only arranged after confirmation of payment by HORSES AUCTION. No horses/passports may be transferred to the buyer or transporter or other third parties until HORSES AUCTION has confirmed in writing that the full payments have been verified on HORSES AUCTION’s account. (not based on screen shots or payment statements).
8.3. Export in EU – Intra-Community delivery. Buyers have to send the correct VAT number and signed “Statement of transportation of goods” document to HORSES AUCTION.

8.4. Export outside the EU: The applicable VAT has to be paid in advance or as a deposit and this will be refunded after the buyer delivers the official customs document of the export within 6 weeks after the payment date. After 6 weeks, the VAT has to be reclaimed by the buyer in the country of destination.

Tutte le parti confermano espressamente, al momento della loro partecipazione, di aver letto e accettato le informazioni generali, i termini e le condizioni generali e le informazioni e i termini e le condizioni per i venditori. Verrà chiesto loro di leggere e accettare i termini e le condizioni ogni volta che creano un account, fanno un’offerta e registrano un articolo.

1. Generale

1.1. Horses Auction (HA) organizza nella sua funzione di intermediario tra venditori e acquirenti l’asta Horses Auction. L’organizzazione, la preparazione e l’esecuzione dell’asta sono determinate esclusivamente da Horses Auction. Ciò significa, tra le altre cose, che HA determina l’andamento degli affari prima, durante e dopo l’asta e ha l’autorità di non mettere all’asta uno o più lotti o di rifiutare di riconoscere un’offerta e dichiararla non valida e di sospendere, riprendere l’asta, di estendere o annullare e/o di adottare altre misure che ritiene necessarie.

1.2. Questi termini e condizioni dell’asta sono applicabili a tutti i contratti di vendita conclusi durante l’asta relativi ai cavalli/pony/lotti offerti tramite Horses Auction, nonché a tutti gli accordi derivanti da ciò.

1.3. Questo contratto – e gli accordi che ne derivano – sono disciplinati dalla legge belga. Solo il testo olandese sarà vincolante.

1.4. Questi termini e condizioni vengono annunciati prima dell’inizio dell’asta includendoli nel catalogo dell’asta o pubblicandoli sul sito web di Horses Auction. Tutti i partecipanti all’asta, prendendo parte all’asta, accetteranno che questi termini e condizioni siano applicabili durante l’asta e qualsiasi accordo derivante dall’asta.

2. Vendita/Asta

2.1. Durante l’asta, i cavalli mostrati da Horses Auction saranno presentati in mano o sotto la sella (asta online al 100% tramite foto/video). Horses Auction non è proprietaria di nessuno dei lotti e non ha alcun interesse diretto o indiretto nei lotti selezionati. Horses Auction offrirà solo una piattaforma per potenziali acquirenti per acquistare cavalli/pony/lotti direttamente dai proprietari dei lotti interessati.

2.2. I lotti saranno venduti durante l’asta tramite offerte in euro, salvo diversa indicazione. Il banditore può determinare un altro incremento di offerta prima di iniziare la procedura di offerta su un lotto specifico. I potenziali offerenti/acquirenti saranno tenuti a rispettare le loro offerte fino a quando non verrà ricevuta un’offerta più alta. Se il banditore aggiudica un’offerta a un acquirente, l’acquirente in questione è tenuto a pagare l’importo dovuto come definito nell’articolo 3. In caso di dubbi sulla validità di un’offerta, l’offerta precedente può essere nuovamente accettata, dopodiché l’offerta può riprendere. In caso di controversie derivanti con o durante il processo di offerta, la decisione del comitato d’asta sarà vincolante.

2.3. L’acquirente, subito dopo la caduta del martello, compilerà e firmerà il contratto di acquisto per la vendita del cavallo specifico. Le offerte telefoniche e le offerte online sono direttamente vincolanti. Con la firma del contratto di acquisto o l’inserimento di un’offerta online, verrà realizzato un obbligo di pagamento e sia un contratto di acquisto vincolante tra acquirente e venditore sia un accordo di mediazione tra Horses Auction e acquirente e Horses Auction e venditore.

3. Liquidazione degli importi e delle spese d’asta

3.1. L’importo dovuto dall’acquirente sarà calcolato come segue:

Prezzo di aggiudicazione dell’asta offerta più alta per il lotto + IVA [La % IVA è indicata per lotto nel catalogo]
+ Più commissione del 10% sul prezzo di aggiudicazione + IVA [21% IVA a Horses Auction vzw Belgio]
= Importo da pagare [L’IVA finale addebitata dipende dal sistema IVA dell’acquirente, del venditore/lotto e dal paese di esportazione (vedere anche il punto 8.)]

L’importo pagabile dall’acquirente diventerà immediatamente pagabile. Il pagamento deve essere effettuato tramite bonifico bancario. È esclusa la liquidazione di eventuali contropretese.

3.2. Subito dopo il completamento dell’asta, l’acquirente è tenuto ad adempiere a tutti i suoi obblighi nei confronti dell’ufficio aste. I pagamenti devono essere effettuati entro il periodo stabilito di 5 giorni per il totale di tutte le offerte e tutti gli altri importi dovuti. I ritiri devono essere effettuati entro 15 giorni dalla fine dell’asta in conformità al punto 5.3. Se un acquirente non dovesse rispettare questo obbligo, Horses Auction avrà il diritto di non riconoscere l’offerta e di dichiarare l’offerta non valida, dopodiché il lotto potrà essere assegnato al secondo miglior offerente e/o in alternativa il lotto potrà essere nuovamente messo all’asta, con l’opportuna menzione dell’offerente frivolo. In questi casi l’acquirente sarà considerato inadempiente e sarà tenuto a risarcire Horses Auction per qualsiasi danno subito, senza pregiudizio di qualsiasi altro diritto di Horses Auction. Tali danni consistono nella commissione (10% + IVA) sull’offerta più alta + la differenza tra l’importo dell’offerta originale e l’importo finale realizzato + l’importo di una quota di registrazione all-in (+ IVA) + i costi menzionati al punto 5.3. L’importo dei danni è direttamente risarcibile.

3.3. L’importo dovuto dal venditore e le condizioni del venditore devono essere concordati in un accordo separato.

3.4. European Sport Horse Auction ha il diritto di raccogliere informazioni sulla situazione finanziaria di uno specifico offerente/acquirente e partecipante all’asta e può decidere di rendere condizionata la conclusione di un accordo con l’offerente/acquirente in questione, in base alle informazioni ottenute e di chiedere garanzie come una garanzia bancaria, una lettera di credito o qualsiasi altra garanzia.
Depositi: per offrire un numero illimitato, è necessario versare un deposito rimborsabile una tantum. Horses Auction rimborsa un deposito su semplice richiesta via e-mail se non ci sono offerte aperte, fatture, debiti o trasporti/Tracce. Elaborato in massimo 15-30 giorni (il ritardo e la commissione dipendono dal metodo di pagamento). Naturalmente gli offerenti possono sempre scegliere di lasciare un deposito sul conto deposito, in modo da non dover pagare di nuovo ogni volta se vogliono partecipare a una nuova asta una settimana dopo o poco dopo, perché alcuni fornitori di servizi di pagamento potrebbero addebitare una piccola commissione (https://www.mollie.com/pricing#psp-block). La maggior parte degli offerenti lo fa in questo modo. Può essere fatto come preferiscono. I depositi vengono elaborati tramite un sistema separato, Horses Auction preferisce non compensarli con le richieste di pagamento per i lotti acquistati. I rimborsi vanno sullo stesso conto del pagamento in entrata.

3.5. Gli acquirenti hanno la possibilità di stipulare un’assicurazione per il lotto che hanno acquistato con una terza parte. Questa assicurazione non è stipulata da Horses Auction.

4. Cavalli all’asta; responsabilità

4.1. I cavalli/pony/lotti offerti all’asta sono identificati per origine, sesso, colore e anno di nascita, come indicato sul sito web www.www.horsesauction.com

4.2. Per i cavalli sportivi adulti che saranno venduti all’asta, verrà richiesto un esame radiografico condotto almeno 12 mesi prima dell’asta. Verrà richiesto un esame clinico standard (cavalli sportivi) entro un periodo di 45 giorni prima dell’asta.

Le ispezioni richieste di solito sono le seguenti:

Cavalli sportivi e pony ≥ 137 cm: foto radiografiche (max. 12 mesi) + referto radiografico (max. 12 mesi) + referto dell’esame clinico (max. 45 giorni).

Pony ≥ 109 cm: referto dell’esame clinico (max. 45 giorni).

Cavalle gravide: Certificato di gravidanza del veterinario + certificato di monta al più tardi al momento del parto.

Cavalle: Dichiarazione di fertilità del veterinario (max. 100 giorni di età).

Puledri: Rapporto di esame clinico (max. 45 giorni di età).

4.3. I risultati veterinari disponibili possono, se disponibili (in tempo), essere forniti su richiesta dei potenziali acquirenti o visualizzati nel catalogo online prima dell’asta e una spiegazione più dettagliata può essere fornita dai veterinari dell’asta, dai loro delegati o (un) sostituto/i nominato/i dall’organizzazione Horses Auction.

4.4. Horses Auction ha quindi cercato di offrire all’asta cavalli sportivi sani, adatti allo sport in termini di salute. Nonostante le precauzioni, Horses Auction non può garantire che tutti i cavalli da mettere all’asta siano clinicamente e radiograficamente sani al momento del parto.
4.4.a. Il nome cavalli sportivi, principalmente in relazione all’idoneità allo sport, non si applica alle categorie All Stars, fattrici, fattrici gravide, ricreazione e accessori. La sezione All Stars include la vendita senza garanzia di alcune parti di cavalli senza ispezione o con osservazioni su raggi X o ispezione clinica o con vizi di stalla.

4.5. Il fatto che vengano richieste ispezioni e relazioni non significa che siano sempre disponibili (puntuali) o che non possano contenere commenti. Horses Auction non può essere ritenuta responsabile dagli acquirenti per reclami basati sulla non conformità del cavallo da mettere all’asta (o qualsiasi altro reclamo basato su questo contesto fattuale), quando si tratta della salute del cavallo, delle prestazioni del cavallo e/o dello scopo di utilizzo dei cavalli. Se gli esami o le informazioni non sono disponibili per la pubblicazione, non è possibile derivarne alcuna garanzia. Si prega di visualizzare le relazioni e gli eventuali commenti prima dell’inizio dell’asta.

4.6. Horses Auction ha cercato di compilare le informazioni disponibili sui lotti nel modo più accurato possibile. Le informazioni mirano a dare la migliore impressione possibile dei cavalli, ma senza pretendere di essere complete. L’organizzazione non è responsabile dell’accuratezza delle informazioni sul sito web e nel catalogo dell’asta, sul sito dell’asta o durante l’asta. Le informazioni del banditore vanno oltre le informazioni sul sito web e/o nel catalogo dell’asta. Firmando il contratto di vendita o cliccando sulla conferma dell’offerta, l’acquirente conferma di essere a conoscenza delle informazioni del lotto e della disponibilità o possibile mancanza di informazioni/ispezioni/relazioni al momento dell’asta. L’acquirente acquista quindi un cavallo nelle condizioni in cui si trova al momento della firma del contratto di vendita (per le aste online: al momento del clic sulla conferma dell’offerta).

4.7. Horses Auction non può essere ritenuta responsabile per danni a persone o beni che si verificano prima, durante o dopo l’asta, ad eccezione dei danni che derivano da dolo o consapevole imprudenza di Horses Auction e delle persone responsabili della VZW.

5. Liberatoria e trasferimento del rischio e della proprietà

5.1. Immediatamente dopo l’accettazione di un’offerta su un lotto, tutti i rischi relativi al lotto acquistato saranno trasferiti all’acquirente e qualsiasi responsabilità e obbligazione, nonché tutti i fattori di rischio saranno trasferiti al rispettivo acquirente. L’acquirente indennizzerà European Sport Horse Auction e il venditore da qualsiasi reclamo presentato da terzi.

5.2. La proprietà del lotto acquistato passa all’acquirente al momento della liberatoria come definito nell’articolo 5.3. di questi termini e condizioni, ma non prima che l’acquirente abbia saldato tutti gli importi di acquisto e i debiti e qualsiasi altro importo dovuto a Horses Auction derivante dalla non conformità.

5.3. L’acquirente è tenuto a prendere possesso del cavallo/pony/lotto acquistato nel luogo e nel momento specificati da Horses Auction/venditore e, in assenza di ciò, entro 15 giorni dalla fine dell’asta (puledri dopo lo svezzamento). I costi di trasporto e gli eventuali costi associati quali certificati sanitari, Traces, analisi del sangue, quarantena, dazi (di importazione) o tasse sono a carico dell’acquirente. Se richiesto da Horses Auction/venditore, ciò avverrà dietro presentazione di un documento di identità valido. La consegna del lotto acquistato avviene tramite il suo ritiro. Il ritiro consiste nel ritiro/ricevimento del lotto acquistato da parte dell’acquirente. Il ritiro può avvenire solo dopo il saldo di tutti i prezzi di acquisto per intero e di tutti gli altri importi dovuti dall’acquirente. Se l’acquirente dovesse rifiutare il rilascio o se non fornisse le informazioni o le istruzioni richieste per il rilascio, Horses Auction/venditore rimuoverà il lotto acquistato e lo conserverà nelle scuderie a spese e rischio dell’acquirente e quindi si fa riferimento al punto 3.2. In questi casi, l’acquirente è tenuto a risarcire tutti i costi aggiuntivi, inclusi in ogni caso i costi di stallaggio, a Horses Auction e/o al venditore.

6. Mancanze (inclusi vizi della stalla)

6.1. Se un acquirente ritiene che il cavallo/articolo acquistato non corrisponda all’accordo dopo l’effettiva consegna, l’acquirente non può più invocare tale circostanza contro HORSES AUCTION se non ne ha informato il venditore e HORSES AUCTION entro 30 giorni (≤29 giorni) dalla data di consegna tramite lettera raccomandata o e-mail con ricevuta di ritorno. Se il ritiro da parte dell’acquirente (o del suo trasportatore) è in ritardo, ovvero:- dopo 15 giorni dalla data dell’asta,- o dopo 15 giorni dalla possibile data concordata per lo svezzamento dei puledri,- o dopo un’altra data di ritiro diversa concordata, il periodo di 30 giorni dalla data di consegna verrà ridotto proporzionalmente a un minimo di 15 giorni dalla data di consegna, a condizione che il venditore stesso abbia soddisfatto le condizioni entro 15 giorni dalla data dell’asta per poter effettuare un trasporto (inter)nazionale fornendo tra l’altro quanto segue da parte del venditore:- il passaporto completo,- la registrazione nel database dei cavalli del paese di partenza,- una registrazione valida in Traces,- e un’adeguata assistenza per effettuare Traces per l’acquirente o il suo trasportatore. Tutte le parti confermano espressamente alla loro partecipazione che HORSES AUCTION si riserva il diritto di proteggere la propria posizione e reputazione affidabile invocando le condizioni risolutive o le sospensioni dei pagamenti menzionate nei termini e condizioni generali e nelle condizioni del venditore in caso di carenze, reclami, consegne incomplete o non conformi. I reclami dopo il periodo sopra menzionato devono essere presentati direttamente tra l’acquirente e il venditore secondo le possibilità legali applicabili.

6.2. Il venditore garantisce, a meno che non ne venga informato prima della vendita, che il cavallo acquistato dall’acquirente non soffre di alcun vizio di stalla come aspirazione d’aria, sistematico zigzag o cribbing per un periodo di 2 x 24 ore dopo l’effettiva consegna all’acquirente.

6.3. Se un veterinario, registrato come veterinario ispettivo per cavalli o un veterinario per cavalli dovesse dichiarare per iscritto che uno dei vizi di stalla elencati nell’articolo 6.2. è stato stabilito nel suo parere di esperto prima della data di effettiva consegna, l’acquirente avrà il diritto di recedere dal contratto di acquisto con tutte le conseguenze che ne derivano. L’acquirente, in tal caso, restituirà il cavallo il più rapidamente possibile al venditore. Fino all’effettiva consegna del cavallo, l’acquirente si comporterà come un buon custode del cavallo. Il venditore accetterà il cavallo e, entro 7 giorni dalla consegna del cavallo, rimborserà il prezzo dell’asta, esclusa la commissione all’acquirente. Il venditore non è responsabile del risarcimento di ulteriori danni del venditore. European Sport Horse Auction non è responsabile di eventuali danni derivanti dalla risoluzione del contratto di acquisto. La risoluzione del contratto di acquisto non influisce sull’accordo di mediazione tra European Sport Horse Auction e l’acquirente.

6.4. La sezione All Stars include la vendita senza garanzia di cavalli senza ispezione o con osservazioni su raggi X o ispezione clinica o con vizi di stalla.

7. Controversie

7.1. Tutte le controversie devono essere dichiarate per iscritto entro 5 giorni lavorativi al comitato d’asta di Horses Auction.

7.2. Se il venditore o Horses Auction intendono avviare un procedimento e se l’acquirente è considerato un consumatore, gli verrà data l’opportunità di annunciare la sua decisione relativa al paragrafo 7.1. per iscritto entro un periodo di un mese. In caso di urgenza (procedura sommaria), il venditore (casu quo Horses Auction) può decidere di abbreviare tale periodo a cinque giorni lavorativi.
7.3. In caso di controversia tra le parti, queste si impegneranno a risolvere tale controversia in via amichevole. Se una delle parti ritiene che non sia stata raggiunta alcuna soluzione, il tribunale designato da HORSES AUCTION ha giurisdizione esclusiva. La legge belga si applica agli accordi tra HORSES AUCTION e altre parti.

8. Altro

8.1. Dopo l’acquisto, HORSES AUCTION invia una richiesta di pagamento all’acquirente con tutti gli importi e i dati bancari. Dopo aver ricevuto tutti i pagamenti completi sul conto di HORSES AUCTION, HORSES AUCTION scambierà i dati di contatto dell’acquirente e del venditore e viceversa per organizzare il trasferimento dei cavalli, dei passaporti e delle fatture o accordi di vendita privati.

8.2. I bonifici bancari potrebbero richiedere del tempo. Organizzare il trasporto solo dopo la conferma del pagamento da parte di HORSES AUCTION. Nessun cavallo/passaporto può essere trasferito all’acquirente o al trasportatore o ad altre terze parti fino a quando HORSES AUCTION non abbia confermato per iscritto che i pagamenti completi sono stati verificati sul conto di HORSES AUCTION. (non in base a schermate o estratti conto di pagamento).

8.3. Esportazione nell’UE – Consegna intracomunitaria. Gli acquirenti devono inviare il numero di partita IVA corretto e il documento “Dichiarazione di trasporto merci” firmato a HORSES AUCTION.

8.4. Esportazione al di fuori dell’UE: l’IVA applicabile deve essere pagata in anticipo o come deposito e verrà rimborsata dopo che l’acquirente avrà consegnato il documento doganale ufficiale dell’esportazione entro 6 settimane dalla data di pagamento. Dopo 6 settimane, l’IVA deve essere recuperata dall’acquirente nel paese di destinazione.
